INVESTIGATION DETAILS: United States export controls have barred Ubiquiti’s airMAX radio bridges from Russia since March 2022. Ubiquiti’s competitors exited the Russian market in 2022, but Ubiquiti is alleged to have kept its distribution channel open in violation of export-control laws, despite having both the contractual and technical means to shut it down. The Company is now a defendant in Kovalenko v. Ubiquiti, Inc., No. 1:26-cv-06838 (S.D.N.Y.), a case brought by Ukrainian civilians killed and maimed in coordinated Russian drone attacks.
SBS is investigating whether Ubiquiti’s directors and officers breached their fiduciary duties by permitting the Company to supply Russian forces in violation of export-control restrictions, resulting in the loss of innocent life.
