Global Immigration Partners Forecasts Key E-2 Visa Trends for 2027
Immigration law firm expects continued demand from international entrepreneurs, increased scrutiny of business viability and greater emphasis on well-documented investment strategies
Global Immigration Partners PLLC, a U.S. immigration law firm advising entrepreneurs, investors and international businesses, has released its forecast for the E-2 Treaty Investor Visa program in 2027.
The firm anticipates continued interest in the E-2 visa from entrepreneurs seeking to establish, acquire or expand businesses in the United States. Demand is expected to remain particularly strong among British, European, Canadian and Australian investors looking for a flexible route through which they can actively develop and direct a U.S. enterprise.
Unlike some investment-based immigration programs, the E-2 visa does not impose a fixed statutory minimum investment. Each application is instead assessed according to the nature and cost of the proposed business, the amount already committed and the investor’s ability to demonstrate that the enterprise is genuine, operational and capable of generating more than a marginal income.
Global Immigration Partners expects five principal trends to shape E-2 visa applications during 2027.
1. Strong demand for established and lower-overhead businesses
Investors are expected to continue showing interest in businesses that can begin operating relatively quickly and demonstrate clear commercial activity. These may include restaurants, cafés, franchises, professional services, technology companies, property-related services, e-commerce businesses and specialist consultancies.
However, selecting a popular industry does not automatically strengthen an application. The investment must be proportionate to the cost of the particular enterprise, and the business must be sufficiently developed by the time the application is filed.
2. Greater scrutiny of whether a business is genuinely operational
E-2 applicants should expect consular officers to examine whether the U.S. business is more than a preliminary concept. Evidence may include executed leases, equipment purchases, licences, insurance, contracts, banking activity, recruitment plans, marketing expenditure and other operational commitments.
Applicants relying primarily on projected expenditure or money that remains uncommitted may face greater difficulty demonstrating that their investment is irrevocably committed and placed at risk.

3. Increased importance of credible financial projections
Business plans are expected to remain a central part of the E-2 application process in 2027. Consular officers may closely examine revenue assumptions, operating costs, staffing plans and the investor’s proposed role in the enterprise.
Projections should be commercially realistic and supported by the amount invested, the relevant market and the actual stage of the business. Generic plans containing ambitious employment or revenue forecasts without supporting evidence may weaken an otherwise viable application.
4. Continued use of escrow and conditional transactions
Escrow arrangements are likely to remain important for investors who need to commit funds while protecting themselves if the E-2 visa is refused. Properly structured escrow agreements may help demonstrate that funds are committed while making the completion of a transaction conditional upon visa approval.
The wording and structure of the arrangement must be carefully considered. Simply holding funds in a personal or ordinary business bank account will not necessarily establish that the investment has been placed at risk.
5. More applicants will plan for long-term immigration objectives
Although the E-2 visa can be renewed while the qualifying business continues to operate and the relevant requirements remain satisfied, it does not directly provide permanent residence.
Global Immigration Partners expects more investors in 2027 to consider their longer-term immigration strategy before committing to a particular business model. Depending on the individual’s circumstances, future options may include the EB-1C multinational manager route, EB-2 National Interest Waiver, EB-1A extraordinary ability classification or another employment- or investment-based category.
Early planning can be especially important where an investor intends to expand internationally, develop a substantial U.S. workforce or eventually pursue permanent residence.
Planning will remain critical for 2027 applicants
Prospective investors should begin planning well before their preferred relocation date. Forming a U.S. company is only one part of the process. Applicants may also need time to transfer and document investment funds, secure premises, negotiate a purchase or franchise agreement, obtain licences and demonstrate that the enterprise is ready to operate.
Source-of-funds documentation is also expected to remain an important element of E-2 preparation. Applicants should retain clear records showing how the investment capital was earned, accumulated, gifted, inherited or generated through the sale of an asset.
